The Problem

The ‘Environmental Damage Law’ (Umweltschadengesetz) came into force on 14 November 2007. It contains new areas of liability for companies. The operator is also liable for public legal claims (and not only for private legal claims as was previously applicable under environmental liability law). The operator is liable for damage to biological diversity i.e. to soil, water, air, flora and fauna. These are forms of ecological damage that amount to general collective damage. Legal claims can therefore be filed by state authorities and not by individuals.

This new law is aimed at compensating the community that was affected by such damage and which previously had to bear the costs for this type of damage.

The Solution
